Dear Mr. Derksen:

Pursuant to sections 602.13(1) and 703.36(1) of the Canadian Aviation Regulations, and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby exempt Transwest Air from the requirement set out in subsection 602.13(1), except where permitted under this section, section 603.66 or Part VII, no person shall conduct a take-off, approach or landing in an aircraft within a built-up area of a city or town, unless that take-off, approach or landing is conducted at an airport or a military aerodrome.

APPLICATION:

This exemption applies to Transwest Air when operating a Bell 206 helicopter.

PURPOSE:

The purpose of this exemption is to allow Transwest Air to deliver Santa Claus by landing at the Market Mall within the City of Saskatoon, Saskatchewan.

CONDITIONS:

This exemption is subject to the conditions submitted in your aerial work zone plan dated 17 November 2003.

Validity:

This exemption is in effect until the earliest of the following:

  1. from 10:45 AM, 22 November 2003 until 12:00 pm 22 November 2003;
  2. the date on which any conditions set out in this exemption is breached; and
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion it no longer in the public interest or is likely to affect aviation safety.
